The FCC’s Build America agenda is rewriting the rules for wireless siting. In September 2026 the Commission adopted an order that narrows federal environmental review under NEPA for most wireless projects that do not require antenna structure registration, while leaving Section 106 historic and tribal review, Endangered Species Act obligations and RF exposure rules in place and asking whether to narrow them further. A separate rulemaking proposes reforms to state and local barriers, including permitting delays, fees and aesthetic requirements. This session explains what has changed, what has not, and what it means for project schedules. Panelists will discuss how to apply the new rules, where Section 106 now becomes the controlling review, how tribal consultation fits, and what to expect from the next round of rulemaking.
